Terms and Conditions

Definitions:

In these Terms and Conditions:
Bodyscape means Bodyscape Wellness Pty Ltd (ABN 39 638 938 584); Terms means Terms and Conditions; and You means you, the person acquiring goods and services from Bodyscape.

Basis of Terms and Conditions:
These Terms and Conditions can be amended by Bodyscape at any time. Reasonable effort will be made to inform clients of changes. Notification of changes will be made via email, published on our website, social media and in studio signage and announcements.

Acceptance of Terms and Conditions is a condition of entry. Continued use of the services and/or payment of membership fees is deemed to be acceptance of these Terms and Conditions.

Bodyscape complies with the Privacy Act. We take the protection of your personal information seriously. Our full privacy policy can be found here. If you have any questions about our Privacy Policy, or if you wish to request access to your personal information, correct or update your details or raise any privacy concerns you may have, please contact us at hello@bodyscape.com.au. The information that you provide to us is stored by our client management software system Mindbody Online. Their Privacy Policy can be viewed here.

Wellness Spa Cancellations

Terms & Conditions:

1. Bodyscape reserves the right to refuse entry.
2. Every possible effort is made to deliver classes and services on
time as advertised. However, the schedule is subject to change or cancellation without notice. Bodyscape is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.
3. The door to the studio is locked at the beginning of each class for safety and security. No late entry is permitted.
4. Bodyscape is not responsible for the safekeeping of your belongings.
5. All purchases are final. Bodyscape does not offer refunds on services or products for change of mind, user error, injury, illness, change of address or any other reason.
6. All passes and memberships are non-transferable.
7. Passes and memberships may not be shared. Anyone caught sharing memberships will be denied entry and forfeit their pass or membership permanently.
8. Group Class Cancellations must be made via the online booking system or mobile app up to 12 hours before a group class penalty. Group Class Cancellations will not be accepted via phone or email. For clients using casual class or class pass, if you do not attend a booked session or cancel within the early cancel window, that class will still be deducted from your class credit/package. For clients using an unlimited (i.e. on membership), if you do not attend a booked session, you will be charged a $10 fee – this is an automatic payment. If you cancel within the early cancel window you will not be charged.

9. There is a 24-hour cancellation policy for private sessions and if you do not cancel your booking within this time or fail to turn up you will be charged the full session amount.

10. For Wellness Spa bookings, if you’re unable to make your appointment, please be aware we require 24-hours notice for all bookings scheduled Monday to Friday, and 48-hours notice for all bookings scheduled on Saturday. 100% charge will apply for any treatments cancelled within these notice periods or for non-attendance. Wellness Spa Cancellations can be made via the online booking system or mobile app, or by emailing hello@bodyscape.com.au
11. No entry is permitted after the class start time and leaving class early is strongly discouraged.
12. Please late cancel if you are unable to attend a class to make your place available to others.
13. Gift cards of dollar value can be redeemed for classes, memberships, spa services or products. They are not redeemable for cash.
14. In attending classes at Bodyscape, you agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Bodyscape or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
15. We reserve the right to increase fees for group classes. We reserve the right to increase fees for private sessions. We will make a reasonable effort to notify clients of changes. Notification of changes will be made via email, published on our website, social media, in studio signage or announcements. Where we have made a reasonable effort to notify you of a fee increase, you authorise us to increase any debits from your nominated account.
16. Please arrive at least ten minutes before a group class or appointment as there is no late admittance. The studios are open 15 minutes before class and appointment start times.
17. Check-in at the desk for all classes, private sessions and Wellness Spa appointments.
18. No personal belongings in the yoga studio other than water and towel. There are lockers for valuable items.
19. No phones in the yoga studio unless prior exemption has been granted.
20. Listen carefully to the teacher’s instructions.
21. You may lie down at any time to take rest, but commit to staying in the room for the entire class.
22. Wipe down your mat and surrounding space before you leave the studio.
23. In attending Bodyscape, you acknowledge that teachers may use tactile cueing and adjustments to maintain a safe experience. Additionally these cueing methods are used to deepen your learning and grow your capabilities.
24. Fees may increase from time to time to reflect updated services and facilities, increase in costs, professional development and further training of our staff.

Class Passes

1. The 10 class pass expires in 3 months of the activation of the pass. The activation date is the date of the first class booked or attended on the pass.
2. No refunds, transfers, suspensions or extensions are offered on unused portions of passes due to illness, user error, injury, change of address or any other reason.
3. Cancellation must be made via the online booking system or mobile app up to 12 hours before a class without penalty. Cancellations will not be accepted via phone or email. If you do not attend a booked session or cancel within the early cancel window, that class will still be deducted from your class package.
4. In the event that we cancel a class within 12 hours of the scheduled start time, we will refund the price of your booking in full.

Casual Classes
1. The activation date is the date of the first class booked or attended on the pass.
2. No refunds, transfers, suspensions or extensions are offered due to illness, injury, change of address or any other reason.
3. Cancellation must be made via the online booking system or mobile app up to 12 hours before a mat class without penalty. Cancellations will not be accepted via phone or email. If you do not attend a booked session or cancel within the early cancel window, that class will be forfeited.
4. In the event that we cancel a class within 12 hours of the scheduled start time, we will refund the price of your booking in full.

Bodyscape Membership

1. No minimum duration of membership.
2. Payments are to be debited weekly/fortnightly dependent on agreed terms.
3. First payment is payable up front with regular debits commencing on the date of the agreement.
4. Debits continue UNTIL FURTHER NOTICE (UFN)
5. Membership continues indefinitely until we (Bodyscape) are notified by you in writing to cancel debits.
6. Your debit amount will remain unchanged and will roll on until cancellation. 1-month written notice is required for cancellation of debits.
7. If you would like to put this membership on hold due to travel, sickness or injury this can be done with a 14-day suspension allowance every 3 months, equivalent to 56 days per year. All suspensions to be received by email to hello@bodyscape.com.au 7-days in advance.
8. Your account will remain active for the entire month after your final payment. Please note that we do not allow suspended memberships to be cancelled.
9. Early cancellation that results in the Termination of Agreement (before minimum agreed duration – noted above) will incur an early termination fee of $100.
10. Missed/failed payments will incur an administration fee of $10.00 (subject to change) and a failed payment fee from your financial institution.

11. Cancellation must be made via the online booking system or mobile app up to 12 hours before a mat class without penalty. Cancellations will not be accepted via phone or email. If you do not attend a booked session or cancel within the early cancel window, you will be charged a $10 fee – this is an automatic payment.

14 Day Intro Offer

1. This membership is available for new students to Bodyscape only.
2. Only one Intro Offer per person.
3. The Intro Offer is valid for 2 weeks (14 days) as stated on purchase. The activation date is the date of the first class booked or attended on the pass.
4. This membership allows you unlimited regularly scheduled group classes but excludes guest teachers, workshops, retreats, teacher training or other special events.
5. No refunds, transfers, suspensions or extensions are offered on the Intro for any reason.
6. Memberships may not be shared or transferred for any reason at any time. Anyone sharing memberships does so expressly without the consent of Bodyscape will be denied all future entry and forfeit their membership.
7. Class Cancellation must be made via the online booking system
or mobile app up to 12 hours before a group class without penalty. Cancellations will not be accepted via phone or email. If you do not attend a booked session, you will be charged a $5 fee. If you cancel within the early cancel window you will not be charged.
8. No entry is permitted after the class start time and leaving class early is strongly discouraged.
9. In the event of a class cancellation, you will not be eligible for a refund.
